To defend the rights and interests of the profession, maintaining discipline among members, and respecting respective professional standards and duties, APRAM has created a council whose role is to exercise disciplinary power within association and to intervene for the prevention or conciliation of all conflicts between the members, on the one hand, and between them and third parties, on the other hand.
Disciplinary procedure
Procedure and mission:
The Disciplinary Board is seized by a Member of the Association. It can seize it on its own initiative when it becomes aware of a behavior of one of its members incompatible with the spirit of the Association or of any other cause of exclusion.
The mission of the Disciplinary Council is to investigate complaints directed between Members of the Association on the basis of their associative behavior (Non-compliance by a member with the statutes, the code of ethics and the specifications setting the conditions of practice of the profession), or because of their behavior towards another member of the Association.
The various disciplinary sanctions imposed by the Disciplinary Board on the Members of the Association cannot be combined with each other and must be chosen from among the following measures:
Warning
blame
suspension
radiation
Members may take part in the deliberations according to their skills.
The person concerned is summoned by registered letter with acknowledgment of receipt, at least fifteen days before the date of the meeting of the Disciplinary Board where his case will be examined:
- he may present written or oral observations
- he can be assisted by any person of his choice
- he can consult all the documents in the file
During the disciplinary session, a member of the commission presents the offending facts. The person concerned then presents his defence.
The Disciplinary Board may call, in particular at the request of the person concerned, any person whose hearing it deems useful, may receive any certificate, and may order any expertise it deems necessary.
The decision of the Disciplinary Board is deliberated without the presence of the person concerned. The decision must be substantiated and signed by the President. It is immediately notified by registered letter with request for acknowledgment of receipt to the person concerned.
The decision may be appealed to the Management Committee, within fifteen days of its pronouncement. The members of the Disciplinary Board who have already made a decision cannot take part.
The Disciplinary Board may suspend a disciplinary sanction by combining this suspension with an obligation to apologize or to make reparations. Failure to fulfill such an obligation automatically entails the application of the sanction.
The Disciplinary Board is sovereign in its decisions. It reports on its activity every year to the Management Committee and to the General Assembly. He can make public the sanctions taken.
Constitution:
According to the statutes of APRAM, it is composed of a member of the Board of Directors appointed by the President and three members chosen by the General Assembly from among its members or among the honorary members.
The council is composed as follows:
- Mr. Bennet Kjeldsen – BABMARSA
- Mr. Fassy El Fehri – TARROS MOROCCO
It intervenes in case of:
- Failure by a member to comply with the statutes, the code of ethics and the specifications setting the conditions for exercising the profession,
- Loss of membership.
