Preamble :
Considering the Ethics Charter adopted by all the members of the Professional Association of Shipping Agents, Shipping Agents and Charter Brokers of Morocco (APRAM),
Considering that ethics gives any company the possibility of exercising in a professional environment with control, peace of mind and transparency,
APRAM decides to adopt this code of ethics, which each member undertakes to respect.
CHAPTER I: General provisions
The need to affirm and ensure the independence and integrity of the profession requires each member:
– Professional conscience
– Moral integrity
– Volunteering in the participation in the actions of the Association
Article 2: Practice of the profession
Each member, as a representative of the profession, declares that he undertakes, vis-à-vis his peers, to carry out his activity in compliance with the common ethical rules, in particular in terms of communication, commercial action or of the performance of the services.
It also undertakes to comply with national and international rules governing the profession.
Article 3: Dissemination of the APRAM code of ethics and professional conduct
Each member undertakes to distribute this code of ethics to its employees and partners.
CHAPTER II: Relations with customers
Article 4: Quality of services
4.1- The member undertakes to only offer the services relating to his profession, even more, to only offer the services for which he is qualified and authorized to perform in such a way as to give satisfaction to his client
4.2- The member undertakes to provide all the necessary information and documents to his client and his partners on time, within the framework of the commercial agreements binding them
4.3- The member undertakes to inform his client and partners of any regulatory change, modifying the usual working procedures
Article 5: Reciprocal obligations with customers and disputes
5.1- The member undertakes to clearly formulate the terms of the reciprocal obligations with its customers.
5.2- Any incident or dispute with a client likely to hinder the smooth running of the profession must be systematically brought to the attention of APRAM by the member involved.
5.3- Consequently, the member undertakes to inform his client that the office of the Association can conciliate in the event of a dispute
Article 6: Confidentiality
6.1- The member is prohibited from disseminating any information that has been communicated to him expressly confidentially by his client
6.2- The member is prohibited from communicating to his client, or more generally to a third party, any information concerning the client’s staff, which is not strictly organizational or educational.
Article 7: Transparency rules
7.1- The member must provide his services in complete independence and will refuse any complacency incompatible with professional ethics.
7.2- The member undertakes to ensure that its partners reserve absolute respect for the interests of the client
CHAPTER III – Relations with colleagues
Article 8: Adherence to the spirit of the Association
8.1- The member will participate in the activity of APRAM by sharing with the other members his experience, his competence and his information in the interest of the profession
8.2- The member undertakes to respect his commitments for any commercial transaction with another colleague
8.3- The member undertakes to report to the Association any practice in contradiction with the Code of Ethics and the articles of the code of ethics, or likely to harm the profession.
8.4- The member undertakes to favor the submission of any dispute with another member, within the framework of the rules defined in this code, to the conciliation of the Association before any other procedure.
Article 9: Rules of competition
9.1- The member is prohibited from harming a colleague by any steps, maneuvers or declarations contrary to the principles of truth and fair competition
9.2- The member undertakes not to recruit an employee of a competing company without taking into account the conditions which bound him by contract to his former employer, except by agreement between the two parties.
9.3- The member is prohibited from using against his colleagues the information obtained within the framework of the activities of APRAM
CHAPTER IV: Reconciliation
Article 10: Reconciliation and compliance with the code of ethics and professional conduct
Conciliation is an alternative and amicable settlement procedure with the support of all the parties concerned, using the good offices of the Association.
The request for conciliation is addressed to the Chairman of the Board of Directors of APRAM who decides on its admissibility.
Once declared admissible, a commission is set up by the Board in accordance with the statutes of APRAM and each party is represented on it.
The decisions of this commission are rendered in amicable composition and bind all the parties in dispute.
